Suspension of Eligibility for Drug-Related Offenses

In general, a student who has been convicted under any federal or state law involving the possession or sale of a controlled substance, during a period of enrollment for which the student was receiving federal (Title IV) aid, shall not be eligible to receive any grant, loan, or work-study assistance under this title during the period beginning on the date of such conviction and ending after the interval specified below. For the possession of a controlled substance, the ineligibility period is:

  • First offense: 1 year from the date of conviction
  • Second offense: 2 years from the date of conviction
  • Third offense: Indefinite period of time

For the sale of a controlled substance, the ineligibility period is:

  • First offense: 2 years from the date of conviction
  • Second offense: Indefinite period of time

Drug-related convictions must be for an offense that occurred during a period of enrollment for which the student was receiving federal (Title IV) aid. Convictions only impact financial aid eligibility if the offense occurred while the student was receiving federal financial aid, and the student was tried as an adult. If a conviction was reversed, set aside, or removed from the student's record it does not impact aid eligibility.
